Terms and Conditions
Last updated October 26, 2026
These terms are an agreement between Symphony Learning LLC (“we”) and you, about your use of Tailgate, our software for small businesses, including its website, apps, and customer portals. By using Tailgate, you agree to these terms. If you use it for a business, you agree to them on that business's behalf and confirm you have the authority to do so.
Who uses Tailgate
- Businesses (“customers”) subscribe to Tailgate and decide who on their team can use it, and with which role.
- Team members use Tailgate at a business's invitation. The business is responsible for its team's use.
- Clients of a business may use that business's customer portal to see what the business shares with them and to message it.
Your account
Accounts are created by invitation. Keep your sign-in details and two-step verification secure, and don't share your account. Tell us straight away at support@symphonybiz.ai if you think someone else has used it. You are responsible for what happens in your account.
Acceptable use
You agree not to:
- break the law, or infringe anyone else's rights, using Tailgate;
- upload anything harmful, such as malware, or content you don't have the right to share;
- try to reach accounts, businesses, or data you aren't allowed to, or test, probe, or get around our security;
- send spam or unwanted messages through Tailgate;
- overload, disrupt, copy, resell, or reverse engineer the service, except where the law allows it.
Your data
Each business owns the information it and its team put into Tailgate. We use it only to provide, secure, and support the service, as described in our Privacy Policy. The business is responsible for having the right to store that information, including its clients' details, and for how its team uses it.
Subscriptions and payment
Businesses pay the fees shown when they subscribe, or as otherwise agreed with us in writing. Fees are billed in advance through our payment provider and are not refundable except where the law requires. We'll give at least 30 days' notice before changing a business's price. If payment fails, we may limit access until it's settled.
Text messages
If you choose text-message codes for two-step verification, or texts about new messages, our SMS Terms also apply.
Our service
We work to keep Tailgate available, secure, and backed up, and we may improve or change its features over time. We'll tell businesses in advance about changes that remove something important they rely on. Tailgate and its software belong to us; these terms give you the right to use it, not to own it.
Ending your use
A business can stop using Tailgate at any time; its subscription runs to the end of the period already paid for. We may suspend or close an account that breaks these terms or puts other people or the service at risk, and where possible we'll warn you first. When a business's account closes, it can ask us for a copy of its data within 30 days, after which we delete it according to our retention schedule.
Disclaimers
Tailgate is provided “as is”. To the extent the law allows, we make no warranties beyond those in these terms, including any implied warranties of merchantability, fitness for a particular purpose, or that the service will be uninterrupted or error-free. Tailgate helps run a business but does not give legal, tax, payroll, or employment advice.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, or consequential losses, or for lost profits, revenue, or data. Our total liability for any claim about Tailgate is limited to the fees the business paid us in the 12 months before the claim arose.
Indemnity
A business will defend and compensate us for claims by others arising from its data or from its or its team's breach of these terms.
General
- Changes: we'll post changes here and update the date above. Significant changes will be communicated in the app or by email before they take effect. Continuing to use Tailgate after that means you accept them.
- Governing law: these terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. Any dispute about them will be decided by the state or federal courts in Massachusetts.
- Whole agreement: these terms, our Privacy Policy, and any written agreement between us and a business are the whole agreement about Tailgate. If any part can't be enforced, the rest still applies.
